2. PURPOSE OF THE WEBSITE
2.1 Definition of the Website
The purpose of these clauses is to establish the guidelines governing access to and use of our platform. For the correct interpretation of this document, the Website is defined as the set of the following elements:
Interface and Design: Both the visual appearance (the so-called "look and feel") and the navigation structure, whether presented statically or through dynamic elements.
Content: All components integrated into the platform, including, without limitation, texts, photographs, graphics, sound files, databases, multimedia developments, artistic works, broadcasts and any technical or intellectual creation. This applies regardless of their current or future medium, and whether or not they are protected by intellectual property, industrial property or similar laws.
Services: Any online resource or service made available to the public through the portal.
Company powers
Trivity has full freedom to unilaterally alter, without prior notice, the structure, design or configuration of the website, as well as the Content and Services hosted on it.
The user also acknowledges that the company has the power to suspend, remove or interrupt access to any of the elements that make up the Website at any time.
2.2 Purpose and functionalities of the Site
This website, its subdomains, interfaces, applications, widgets, APIs and other associated digital environments (collectively, the "Site") are intended to provide information and access to the technology services provided by Trivity.
Trivity is a technology platform that connects activities from the local tourism ecosystem with accommodation providers, agents and tourism operators in a single web environment, in order to facilitate fast, direct bookings between agents or tourism operators and activity providers, allowing:
- the display of tourist activities offered by third-party providers;
- the recommendation or prescription of such activities by professional agents;
- the channelling and management of activity bookings made by end users; and
- the centralized settlement of commissions or payments between agents and providers.
The Site does not constitute a direct sales portal for activities, a consumer marketplace, a travel agency or an organizer of tourist activities.
2.3 Nature of the service
Trivity provides technology services exclusively. Under no circumstances does Trivity:
- organize, operate or carry out activities;
- act as a provider of tourist experiences;
- assume the status of travel agency or regulated tourism intermediary;
- guarantee the execution, quality, safety or legality of activities offered by third parties.
The material execution of the activities corresponds solely and exclusively to the Providers offering them.
3. GENERAL TERMS OF USE AND LIABILITY
3.1 General access to the Site
Access to and use of the Site may correspond to different profiles:
- end users;
- professional agents;
- activity providers;
- informational visitors.
Access to this Site by any person confers the status of site user and implies acceptance of these general terms in the version published at the time of access, as well as any other particular service terms that may apply to the user.
This site has been designed to publicize and allow general access by all Users to the information, activities, products, services and/or solutions offered by Trivity.
Access to certain content offered through this site, its subdomains, interfaces, applications, widgets, APIs and other associated digital environments may be subject to certain specific conditions which, depending on the case, replace, supplement and/or modify these general terms. Therefore, before accessing and/or using such content, the user must also carefully read the corresponding specific terms.
3.2 Use of the Site
3.2.1 Obligation to make proper use of the Site
The user undertakes to use the Site in accordance with the law, these general terms, generally accepted morals and good customs, and public order.
The user undertakes not to use the Site for activities contrary to the law, morals or public order, for unlawful purposes or effects, contrary to the provisions of the general terms of use, harmful to the rights and interests of third parties, or in any way that may damage, disable, overload or impair Trivity's service or Site, prevent the normal use or enjoyment of the service by users, or copy databases for the user's own commercial purposes without Trivity's express authorization. Accordingly, users shall refrain from engaging in conduct which, by way of example and without limitation:
- contravenes, undermines or violates fundamental rights and public freedoms recognized in the Constitution, international treaties and the rest of the legal system;
- induces, incites or promotes criminal, denigrating, defamatory, infamous, violent or, in general, unlawful conduct or conduct contrary to generally accepted morals and good customs or public order;
- induces, incites or promotes discriminatory actions, attitudes or ideas on grounds of sex, race, religion, beliefs, age or condition;
- incorporates criminal, violent, pornographic, degrading or, in general, unlawful messages or messages contrary to generally accepted morals and good customs or public order;
- induces or may induce an unacceptable state of anxiety or fear;
- induces or incites involvement in practices that are dangerous, risky or harmful to health and psychological balance;
- is false, ambiguous, inaccurate, exaggerated or untimely, in such a way that it may mislead as to its subject matter or as to the intentions or purposes of the communicator;
- is protected by any intellectual or industrial property rights belonging to third parties, unless the User has previously obtained from the owners the authorization necessary to carry out the use made or intended;
- violates third-party trade secrets;
- is contrary to the right to honor, personal and family privacy or the image of individuals;
- infringes the rules on secrecy of communications;
- constitutes unlawful, misleading or unfair advertising and, in general, unfair competition;
- causes, due to its characteristics (such as format, length, etc.), difficulties in the normal operation of the Service, or fails to comply with the technical requirements or specifications established for access to the website.
The user is solely responsible for the personal information provided through the various means of communication made available on the website, and must be aware that such information may be viewed by third parties.
3.2.2 Liability for damages
The user shall be liable for damages of any kind that Trivity may suffer as a result of the breach of any of the obligations to which the user is subject by virtue of these terms of use and the law, in relation to the use of the Site.
3.3 Exclusion of warranties and liability
3.3.1 Availability, continuity, usefulness and reliability of the Site
Trivity does not guarantee the availability and continuity of the operation of the Site and its Services. The user acknowledges that, technically, it is not possible to achieve absolute and permanent availability of the Site, since this does not depend directly and exclusively on the company. Nevertheless, Trivity works to keep it continuously and uninterruptedly available. Users are informed that, for maintenance, technical update or security reasons, as well as due to incidents outside Trivity's control (for example, public communication network anomalies, power outages, cyberattacks, etc.), temporary suspension of the services or certain anomalies in the provision of services may occur. When reasonably possible, Trivity will give prior notice of interruptions in the operation of the Service. Trivity also does not guarantee the usefulness of the Service for carrying out any particular activity, nor its infallibility and, in particular, although not exclusively, that users may effectively access the different web pages of the Site, or that information, data or content will be effectively transmitted to third parties through this Service, or that information, data or content will be effectively received from third parties.
Trivity excludes any liability for damages of any kind that may arise from the lack of availability or continuity of the service, from the service not meeting the usefulness expected by users, or from service failures and, in particular, although not exclusively, from failures in accessing the different pages of the Site, as well as failures in the transmission or receipt of information, data or content.
3.3.2 Use of the Service by users
Trivity has no obligation to monitor and does not monitor the use that users make of the Service. Nor does it guarantee that users use the Service in accordance with these terms of use or that they do so diligently and prudently. Trivity has no obligation to verify and does not verify the identity of users, nor the truthfulness, validity, completeness and/or authenticity of the data that users provide about themselves.
Trivity excludes any liability for damages of any kind that may be due to the use of the service by users or to the lack of truthfulness, validity, completeness and/or authenticity of the information provided by users and, in particular, although not exclusively, for damages of any kind that may be due to the impersonation of a third party by a user in any kind of communication made through the web service.
3.4 Refusal of use of services
Trivity reserves the right to refuse the use of certain Services in which the user is an active party or registers, and to prevent and remove communications made through them, at any time and without prior notice, with respect to users who breach these general terms.
The following is a list of actions not permitted in the use of these services in which the user has an active role on the Site:
- attempting to access the service outside its normal use or without using a web browser;
- submitting a large number of requests to the Site in a way that generates an excessive system load;
- using another person's ID or password without authorization;
- engaging in conduct equivalent to unauthorized access or conduct that causes or creates security breaches;
- engaging in unlawful acts;
- engaging in conduct that may constitute a criminal offence;
- infringing intellectual property rights, including copyright and patent rights;
- disturbing public order or morality;
- engaging in conduct that may reasonably be considered socially inappropriate;
- engaging in conduct that Trivity considers inappropriate according to the practices and customs of the sector;
- providing false user registration details;
- failing to use the service for a certain period after registration; or
- breaching the applicable service terms.
3.5 Protocol for reporting unlawful activities
If a user or third party considers that the use of certain content, services or activities within this Website is unlawful or infringes legitimate rights, they may notify Trivity.
In order for such claim to be processed, it must be sent to the entity's registered office (indicated at the beginning of this document), providing the following documentation and information:
Claimant details
- Full identification: name, surname and national identity document number (or passport).
- Contact information: postal address, telephone number and email address.
- Representation: If acting on behalf of the holder of the rights allegedly infringed, the signature (physical or digital) of the holder or of the person legally authorized to represent them must be included.
Description of the infringement
- Details of the activity: precise explanation of the facts or circumstances that reveal the unlawful nature of the activity in question.
- Intellectual or industrial property: If the claim is due to an alleged infringement of copyright or trademarks, a specific description of the protected content and its exact location (URL or specific section) within the Trivity Website must be provided.
4. INTELLECTUAL AND INDUSTRIAL PROPERTY
Trivity is a trademark protected by intellectual and industrial property rights, and therefore any use of it or of any similar identifying sign that may cause confusion regarding its origin or ownership by third parties is expressly prohibited without prior written authorization from Trivity Tech, S.L.
www.trivityapp.com is a domain registered by Trivity Tech, S.L. This domain may not be used, unless prior express authorization is granted, in connection with other services that are not those of the company in any way that may cause confusion among our clients or users or discredit the company.
This entire website, including its description and features, text, images, trademarks, logos, buttons, software files, code, color combinations, as well as the structure, selection, arrangement and presentation of its content, is protected by Spanish and international intellectual and industrial property laws, including, by way of example and without limitation:
- the elements that make up the visual appearance, graphic image and other sensory stimuli of the web pages that make up the Website;
- the navigation architecture;
- the source codes of the web pages;
- photographs;
- recordings;
- computer programs;
- databases;
- technology;
- logos; and
- distinctive signs.
Under no circumstances does access to this site imply any waiver, transfer or total or partial assignment of the rights granted by Spanish and international intellectual and industrial property legislation.
Reproduction (except temporary downloading from the website to the user's computer hard drive or proxy servers), copying, use, distribution, reuse, exploitation, making of second copies, sending by mail, transmission, modification, assignment or any other act carried out with all or part of the information contained on this website that has not been expressly authorized by the owner is prohibited.
The user undertakes to use the content diligently, correctly and lawfully and, in particular, undertakes not to remove, circumvent or manipulate the copyright and other identifying data of the rights of Trivity Tech, S.L. or of their holders incorporated into the content, as well as technical protection devices or any information mechanisms that may be included in the content. Likewise, the user shall refrain from using the content and, in particular, any information obtained through the site to send advertising, communications for commercial purposes, unsolicited messages addressed to a plurality of persons regardless of their purpose, and from marketing or disclosing such information in any way.
5. THIRD-PARTY CONTENT AND EXTERNAL LINKS
5.1 Advertising, images or activity of third parties
Given the type of services provided by Trivity, the environment of its Website or App may include third-party content such as agents, activity providers or other external services. These agents or providers shall be solely responsible for ensuring that the material submitted or uploaded directly by them for inclusion on the Site fully complies with the legislation that may be applicable in each case, especially with respect to rights over images, trademarks or logos that it may include.
Trivity:
- does not control or validate such content;
- does not guarantee its accuracy, completeness or lawfulness;
- assumes no liability for it.
Any contractual relationship that the user establishes with third parties is carried out under the user's sole responsibility.
5.2 Links from third-party websites
With regard to links established by other pages to this Site, and if any user, entity or website wishes to establish any type of link to the Trivity Site, the following provisions must be observed:
- The link may only point to the home page.
- The link must be absolute and complete, meaning that it must take the user to Trivity's own address and must completely cover the full screen extension of the home page. Under no circumstances, unless expressly authorized in writing by Trivity, may the page creating the link reproduce Trivity's website in any way, include it as part of its own website or within one of its frames, or create a browser over any of the website pages.
- No false or incorrect indication may be given about Trivity's page.
- If any distinctive sign of Trivity, such as trademarks, logos or name, is to be displayed, written authorization must be obtained.
- The owner of the page offering the link must act in good faith and must not seek to negatively affect Trivity's reputation or good name.
- Unless expressly authorized by Trivity, it is prohibited to register the textual elements of the trademark or logo, the domain name or the corporate name of Trivity as keywords ("metatags" or "metanames") for website searches carried out through search engines.
- Trivity assumes no liability for any aspect relating to the website offering the link. The establishment of the link does not imply the existence of any relationship, collaboration or dependence between Trivity and the owner of that website.
6. PERSONAL DATA PROTECTION
The processing of personal data carried out through the Site is governed by Trivity's Privacy Policy, permanently available at https://trivityapp.com/en/privacy-policy-en/.
The use of cookies is governed by the corresponding Cookie Policy.
7. DURATION AND MODIFICATION OF TERMS
Trivity shall have the right to modify the terms and conditions set out herein unilaterally, in whole or in part. Any change will appear in the same form in which it is included in this legal notice.
The temporary validity of this legal notice therefore coincides with the time during which it is displayed, until it is modified in whole or in part by the company.
Trivity may unilaterally terminate, suspend or interrupt the operation of this website, without the user being able to request any compensation. Following such termination, any user who is an agent, professional or provider must destroy any information about Trivity that they hold in any format and that they obtained through the site or through communications made individually by Trivity.
8. APPLICABLE LAW
This Legal Notice is governed entirely by Spanish law.
For any dispute relating to these terms of service, the parties expressly agree to submit to the Courts of Barcelona (Spain) and the corresponding Spanish law. Although Trivity does not carry out electronic commerce, users are informed that, in accordance with Article 29 of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, in any dispute where the affected party is a consumer, that party may freely choose their habitual place of residence for the filing of legal actions.
